3.3 Service Limitations

Our coaching services are educational and developmental in nature. We do not guarantee specific outcomes such as job offers, salary increases, or speaking engagements. Success depends on multiple factors including individual effort, practice, market conditions, and circumstances beyond our control.

4. Registration and Account

4.1 Account Creation

To access certain Services, you may need to create an account by providing accurate and complete information. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use
• Ensuring your contact information remains current

4.2 Account Termination

We reserve the right to suspend or terminate your account if you:

• Engage in fraudulent or illegal activities
• Behave in a manner that is abusive, threatening, or harassing toward our staff or other clients

5. Fees and Payment

5.1 Service Fees

Fees for Services vary based on the type, duration, and format of coaching selected. Current pricing is available upon request or through our Website. All fees are stated in U.S. Dollars unless otherwise specified.

5.2 Payment Terms

• Payment is required in advance unless alternative arrangements are agreed upon in writing

5.3 Late Payment

6. Scheduling and Cancellations

6.1 Appointment Scheduling

• Sessions are scheduled by mutual agreement between the client and coach
• We will make reasonable efforts to accommodate your preferred schedule
• Confirmation of appointments will be provided via email
• It is your responsibility to ensure you receive and review appointment confirmations

6.2 Cancellation Policy

• Client Cancellations: You must provide at least 24 hours' notice to cancel or reschedule a session without penalty
• Late Cancellations: Cancellations with less than 24 hours' notice may result in forfeiture of the session or payment of a cancellation fee
• No-Shows: Failure to attend a scheduled session without prior notice will result in forfeiture of the session fee
• Company Cancellations: If we must cancel or reschedule a session, we will provide reasonable notice and offer alternative scheduling options

6.3 Rescheduling

Sessions may be rescheduled with at least 24 hours' notice, subject to coach availability. Repeated late cancellations or no-shows may result in termination of service or requirement of prepayment for future sessions.

7. Client Responsibilities

As a client, you agree to:

• Arrive on time for scheduled sessions (virtual or in-person)
• Come prepared with any materials or information requested by your coach
• Actively participate in sessions and complete recommended exercises
• Provide honest feedback about your progress and challenges
• Treat coaches and staff with respect and professionalism
• Maintain confidentiality of coaching materials and methodologies
• Use Services only for lawful purposes
• Not record sessions without prior written consent

8. Intellectual Property Rights

8.1 Company Intellectual Property

All Content on our Website and in our Services, including but not limited to text, graphics, logos, images, audio, video, software, coaching materials, and methodologies, is the property of Speaking Excellence Center or its licensors and is protected by copyright, trademark, and other intellectual property laws.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID FOR SERVICES IN THE SIX (6) MONTHS PRECEDING THE CLAIM.

11.4 Jurisdictional Limitations

You may terminate Services at any time by providing written notice. Termination is subject to our Refund Policy (see separate Refund Policy document for details).

13.2 Termination by Company

We reserve the right to terminate or suspend Services immediately, without prior notice, if you:

• Breach these Terms
• Engage in conduct that harms or threatens the Company or other clients
• Fail to make required payments
• Provide false or misleading information

13.3 Effect of Termination

Upon termination:

• Your right to access Services ceases immediately
• You remain liable for all fees and charges incurred prior to termination
• Provisions of these Terms that by their nature should survive termination shall continue to apply
• We may delete your account information and Content in accordance with our data retention policies

14. Dispute Resolution

14.1 Informal Resolution

Before initiating formal dispute resolution, parties agree to first attempt to resolve disputes informally by contacting us at [email protected] to discuss the issue and seek resolution.
